BEACON FALLS — A condominium association has filed a lawsuit against a paving company in town over a dispute regarding work promised but never started.
On March 6, the Southington Manor Condominium Association, Inc., which represents the condominiums at 273 Queen St. in Southington, filed a complaint with the New Britain Superior Court against Betkoski Brothers, LLC.
The complaint claims that Betkoski Brothers, which is owned by Selectman Peter Betkoski, entered into a contract with the association to perform paving work last July. The total cost of the work was $9,039 and the association paid the company a 50 percent deposit of $4,519 on or about Aug. 1, 2017, according to the complaint.
The complaint states work was supposed to start within two weeks of the payment, but Betkoski Brothers hasn’t done any of the work. The complaint claims the company also has been either unwilling or unable to return the deposit despite repeated requests to do so.
Betkoski said the company planned on doing the work but he got sick and was hospitalized last year when the paving season was ending. He said cold weather set in while he was sick and prevented the work for the association to start, Betkoski said.
Betkoski said he is currently working with the association to come to resolve the issue.
“We are in negotiations and are resolving it as we speak,” Betkoski said this week.
The lawsuit is seeking compensatory damages, costs, attorney fees and interest, the complaint states.
