Ordinance governs snow disposal

PROSPECT — As winter approaches, Mayor Robert Chatfield wants to remind residents of the town’s new snow disposal and property damage ordinance.

Under the ordinance, which was approved in December 2015, no property owner, contractor, or resident is allowed to plow, throw, or shovel snow or ice into any street or road.

Chatfield said problems arise when the snow left in the street after it’s been plowed can lead to ridges in the street and cause accidents.

The ordinance went into effect in January, but the town did not have time to properly prepare to enforce it this past winter, Chatfield said.

Under the ordinance, violators could be fined up to $100 a day. Each day the violation continues constitutes a separate violation.

“Basically all we are asking is, if you are going to plow a driveway across the road, and that is dangerous too, is to make two passes up the right side and two passes up the left side and leave the road clean,” Chatfield said.

The ordinance also deals with damage to personal property.

Under the ordinance, the town is not responsible for damage to personal property that is located in the right of way during snow removal. The right of way can extend 10 to 15 feet beyond the paved portion of the road.
