Borough settles lawsuit with former fire chief

NAUGATUCK — After years of contention, the borough and former Fire Chief Charles Doback Jr. have reached an agreement.

The Board of Mayor and Burgesses last week approved a general release and settlement agreement between the borough and Doback.

Doback served as fire chief from 2005 until 2010, when he retired from the department amid a contract dispute with the borough.

In September 2013, Doback filed a lawsuit against the borough, claiming that the borough did not fully fund a health savings account for himself and his wife, Joan, as part of his high deductible health plan. The lawsuit claimed that the borough was responsible for fully funding the account after Doback’s retirement.

At the time the lawsuit was filed, Doback was seeking the borough to fully fund his health savings account and reimburse him $15,000 for the money he had to put into the account.

The agreement approved last week fully funds the Dobacks’ health savings account and pays him $5,000 for contributions that he made to his own account.

Under the agreement, Doback will drop the lawsuit he filed against the borough and not seek any other compensation or action against the borough.

The Dobacks are also responsible for their own attorney fees, according to the agreement.

When Charles and Joan Doback turn 65 they will be enrolled in the retirement supplemental medical plan offered by the borough, the agreement states.

Under the agreement, Charles Doback is barred from seeking employment or a business relationship with the borough.
