Man facing child porn, voyeurism charges

NAUGATUCK — A man who police say downloaded more than 100 images of child pornography told law enforcement that he didn’t know it was illegal to do so.

“They were on the internet; I figured it was OK,” he told police.

A Naugatuck police investigation revealed that Marshall Falzone, 50, had 102 images and 34 videos of child pornography on his laptop computer. That laptop also contained videos of him engaging in sex acts with a woman who told police that she did not know Falzone was videotaping the acts; Falzone also videotaped the woman getting changed, according to police.

Falzone had images on his computer of girls between the ages of 8 and 15 in various nude positions, the investigation reveals. The images show some of the girls engaging in sex acts with adult males; one girl, who appears to be between 10 and 12 years old was performing a sex act on a dog, according to the investigation.

The investigation was initiated in November 2012. Police were tipped off after AOL intercepted images that they say Falzone attempted to transmit over the Internet.

At the time, Falzone was living in an apartment in Naugatuck. Falzone’s booking information lists his current address as 2 Jeanette St. in Danbury.

AOL notified the National Center for Missing and Exploited Children, as required by law. These “cybertips” were passed on to Connecticut State Police and Naugatuck police.

Amanda Devan, a detective and the youth officer for the Naugatuck Police Department, was the lead investigator on the case. She found Falzone’s address through the Naugatuck Post Office and obtained a search warrant.

When approached by police, Falzone initially said that several women use his computer. He then said he has been trading pornographic pictures for years, according to police.

“I thought that because it was on my computer, it was OK to do. … I have downloaded, I think, thousands of photos that were sent to me on Facebook and MySpace,” he told police, according to the investigation.

Police allege that Falzone set up his video recorder on his cellphone and placed it in a position in his room to record himself having sexual relations with the woman in the videos.

Falzone turned himself in on a warrant Jan. 31 and was charged with possession of child pornography in the first degree and five counts of voyeurism. He was given a court date of Jan. 31 and held on a $150,000 bond.
